Collection Agency Tips for Indianapolis Businesses

We are often asked by our clients to go after collection fees during our normal collection effort.  Here in the USA, this is typically not possible unless there is a signed written agreement between your company and your customer’s company that explicitly states this provision.  The same holds true for collecting attorney fees, and just adding the provision to your invoices may not be enough.  You need to have your customer sign a document indicating they agree to this provision and we recommend adding the provision to your Credit Application because this is usually filled out by your customer at the very beginning of your working relationship.  It is important to include collection costs so that collection agencies are able to add this fee into the principal due amount they are working to recover in the pre-litigation stage of the collection effort.   Anticipated attorney fees are not collectible in the pre-litigation stage; they would be added if legal action is taken down the road.  Collection costs may or may not be collected by the agency, but having the right to collect them provides the collection agency with significantly more negotiation leverage throughout the debt collection, litigation and judgment collection activities.
