Collection Agency Tips for Sacramento Businesses

In our opinion, if you are choosing between arbitration or going to court to solve a debt collection dispute, you are better off going to court.  When comparing the costs of court related filing fees with the costs of arbitration, arbitration costs will typically be higher because you are required to pay an hourly rate to the arbiter for his or her time.  Additionally, when using arbitration, your ability to do discovery is more limited than when you are litigating, which can be particularly important if the debtor is disputing the principal due amount, or in the rare instance where the debtor is totally making up the dispute.  In litigation cases, many courts allow for pre-judgment attachments which put increased pressure on the debtor more quickly, and is not something that can occur in arbitration.  Finally, we have a network of attorneys who handle collection litigation for us on a contingency fee.  In arbitration cases, a retainer is typically required.  While many companies prefer arbitration for handling disputes, we encourage our clients to have terms and conditions that specify debt collection cases can be litigated or arbitrated at our client’s sole discretion.
